TRADUCTION
[Iddin-Nabû/]Nabû-bēlšunu/Ilia said to Marduk-šumu-ibni/Šulā/Ilia, the brother of his father: “The son of Nabû-ušallim/Balāṭu/Ilia, [the son of the brother of the father] of my father, has died and he had no son or brother. His property and his prebends belong to me on behalf of my status as eldest brother (ahu rabûtu) of our “house.” You are the brother of my father - and I am “taken” and my [x] in town is not paid - let me seal and assign the prebends and property to you!” (7) Marduk-šumu-ibni listened to Iddin-Nabû, the son of his elder brother (and agreed). (8) Iddin-Nabû [... (large gap)]. “broken” as heir/legacy [...] the son of Nabû-ušallim, son of the brother of their father [...] Marduk-šumu-ibni/Šulā/Ilia. (3') It will belong [forever to him]. (4') Iddin-Nabû has sworn to Bēl, Nabû, and the adû (“majesty”) of Cambyses, king of Babylon and the lands: “I will not come back (to litigate) against Marduk-šumu-ibni about that property.” (8') Witnesses: Taqīš-Gula/Tabnēa/Esagil-mansum, [PN/x]-mukīn-apli/Ilia, Rēmūt-Nabû/Nabû-ēṭer/[Ilia?, PN]/Marduk-šumu-ibni/Mallahu. (11') [Scribe: Nabû-bēlšunu]/Mušēzib/Itinnu. Borsippa, Camb [-].
REMARQUES
With the death of Iddin-Nabû’s second cousin, who remains unnamed in this text but whom we know as Nabû-kuṣuršu from BM102308 no. 18 (Camb 05) and BM 85225 no. 21 (Dar 03; posthumous), one lineage of the Ilia A family became extinct. Iddin-Nabû, who was the only son of the eldest son of the eldest son of the common ancestor (Ṣillā), inherited the property and prebends of Nabû-kuṣuršu, but he declared himself unwilling or unable to take full responsibility of the legacy, apparently because he had outstanding debts (l.6). Iddin-Nabû therefore forfeited the rights that befell him as the family’s big brother, and assigned the property and prebends to Marduk-šumu-ibni, his father’s younger brother.
We should not take this text at face value, however. As so often, this prebend text is to a certain extent a legal fiction. This becomes apparent in a document drafted some years later (BM 85225 no. 21 and duplicate BM 85233). In Dar 03, Iddin-Nabû had still not transferred Nabû-kuṣuršu’s inheritance to Marduk-šumu-ibni. He finally agreed to do so now but the items that he signed over did not entirely match with what was promised in BM 82695 no. 19. Instead of Nabû-kuṣuršu’s entire inheritance of prebends and property, Marduk-šumu-ibni received only half of the prebends (consisting of brewer’s and gatekeeper’s titles) in Dar 03. Iddin-Nabû kept the other half for himself. Moreover, BM 85225 no. 21 also reveals that Marduk-šumu-ibni paid a sizeable sum of silver for the prebends (3⅓ minas of silver), showing that Nabû-kuṣuršu’s inheritance was not just distributed among the surviving family members but sold within the family.
NOTES
(2)         Nabû-ušallim’s unnamed son was Nabû-kuṣuršu. He was still alive in Camb 05 (BM 102308 no. 18), but the fact that he was mentioned together with his mother at that occasion shows that he was still a child then, and that he died young (BM 82695 no. 19). In keeping with Iddin-Nabû’s statement, no sons or brothers of Nabû-kuṣuršu are recorded; no brothers of Nabû-ušallim are known. With Nabû-kuṣuršu’s death, the descent line of Balāṭu/Ṣillā died out.
(3)         [dumu šeš ad a]d-ia: cf. BM 85225 no. 21: 10.
(5)         What did Iddin-Nabû mean by saying that he was “taken”? Several interpretations are possible. He could have been imprisoned (cf. CAD Ṣ 8), overburdened with work (CAD Ṣ 21), or he could have been pondering what to do with the legacy of Nabû-ušallim’s son (CAD Ṣ 22). The fact that he admitted to have debts (l.6) might point in the direction of imprisonment.
(1')        hé-pi: BM 82695 is a copy of a damaged original.
(2')        “Their father” must refer to Šulā/Ṣillā/Ilia; he was, to be correct, the father of Marduk-šumu-ibni but the grandfather of Iddin-Nabû.
(9'f.)     Probably Rēmūt-Nabû/Nabû-ēṭer/Ilia, cf. BM 26692: 8 (Camb [-]), BM 29058 no. 60: 16 (Nbn 16).
(11')     This scribe wrote many tablets of the Ilia archive, e.g., BM 26099 Cyr 02, BM 82760 Nbn 12, BM 87332 Nbn 10, BM 103389 Nbn 12, BM 102313 no. 15 Cyr 06 and many others.
