– the upper side next to the broad street [and next to] the house of 6 nikkassu [received] from Iddin-Nabû//Aškāpu
– the lower side next to the small through-street
– the upper front next to the house of Nabû-ēṭer-napšāti/Tabnēa/[Nūr]-Papsukkal and next to the house of Itti-Marduk-balāṭu//Ilšu-abūšu

– the lower front next to Nabû-nādin-šumi/Nabû-šumu-ukīn/Iddin-Papsukkal
And one third of the prebends and fields of Šulā, as much as there is, he (= Šulā) sealed and assigned forever to Marduk-šumu-ibni, Nabû-ēṭer-napšāti and Nergal-iddin, his younger sons, the later sons.
He (= Šulā) sealed and assigned to Marduk-šumu-ibni [his second son (?)], on top of his share (and) instead of his house:
bīt-šutummi of 12 reeds, next to the large bīt-šutummi, (reaching) from the unbuilt area until the small through-street

(and) a field of 0;3.2 in tamirtu Bīt-Eṭrāya, part of the property which is held in common with his (Šulā’s) brother Itti-Nabû-balāṭu.
He (= Šulā) sealed and assigned forever to Nabû-ēṭer-napšāti, his third son:
A (part of a) house of 6 nikkassu in the district of the Lapis Gate in the centre of Borsippa, which was received from Iddin-Nabû//Aškāpu:
– upper side next to the broad street

– upper front next to the same plot
– lower front next to the house of Marduk-šumu-uṣur//Nūr-Sîn
The previous tablets that (he sealed) to the name of [Ṣil]lā? and to the name of Tabnēa and Libluṭ [and] the previous tablets that Šulā sealed to (the name of?) the sons of [pn]: they are all broken. They have sworn an oath by Nabû.
At the sealing of the tablet are present: Marduk-šāpik-zēri/Nabû-lē’i/Ilia, Nabû-nādin-šumi/Lūṣi-ana-nūri-Marduk/Bēl-ušumgal, Nabû-šumu-iddin/Nabû-kāṣir/Nūr-Papsukkal, Nabû-mukīn-zēri/Taqīš-Gula/Siātu, Nabû-bēlšunu/Šulā/Ilia, Marduk-šumu-ibni/Šulā/Ilia. (46) Scribe: Nabû-šumu-ukīn/Šamaš-šumu-līšir/Esagil-mansum. (47) Borsippa, Nbn [x]-xii-02.
REMARQUES
BM 26498 records the division of an inheritance with four heirs. The name of the testator is broken off, but he is certainly to be identified with Šulā son of Ṣillā from the Ilia (a) family. This is underpinned both by the museum context of the tablet and the prosopographic evidence from the Ilia A archive (see i.2.1). In support, we can refer to BM 17657 Nbn 13 where all four brothers are mentioned with patronymic and family name. Moreover, Šulā’s name appears in l.37 of BM 26498.
The model of division used in BM 26498 is ⅔ : ⅓ (ll.2, 15). At first sight this is surprising, for that model was normally used when there were only two heirs and Šulā had four male heirs. His sons, however, were born from different marriages: the eldest son, Nabû-bēlšunu, was born from his first marriage, the three other ones from his second marriage (mārū arkūtu, l.18). The three junior sons occupied together the position of one younger son in the division scheme. It was common practice to give two thirds of the patrimonium to the sons of the first wife according to the Neo-Babylonian laws (no. 15).
The ⅔ : ⅓ model applied in particular to the prebends and the fields of Šulā’s estate (see ll.[2], 18). Built-up property was treated seperately, and it was for this purpose that bm 26498 was drafted. Nabû-bēlšunu, the eldest son, received a 40 reed house in the city centre at the Lapis Gate and a large storeroom (bīt-šutummi) in the temple district. The house was probably the paternal home and it seems that Nabû-bēlšunu received it in its entirety, except for a very small part of it (cf. below, Nabû-ēṭer-napšāti). Marduk-šumu-ibni, the eldest son of the second marriage, did not get a share of this house but instead (l.27) a reasonably sized bīt-šutummi in the temple district as well as an additional piece of land which he did not have to share with his two younger brothers (elat zittišu, l.16). The third son, Nabû-ēṭer-napšāti, also received an extra share: a very small part of the house at the Lapis Gate. The youngest son, Nergal-iddin, did not get any extra allowance; his only right was to share the one third of the prebends and fields with his two brothers.
NOTES
(5)         This is the property discussed in ll.28-9.
(8)         Family name restored from BM 27879 Nbn 05 (Ilia a archive): 14.
(38)      Reading of the second part of this line courtesy C. Wunsch.
(44-5)  The highly unusual listing of beneficiaries among the witnesses was perhaps meant to underline that the eldest sons of Šulā’s two marriages consented.
